• Every manager is a human resource (HR) manager and needs to manage his subordinates effectively for better industrial harmony and greater productivity.
• Difficult employees not only affect productivity, he also becomes a burden to the manager/organization.
• Every manager need to know how to manage difficult employees effectively so that it does not escalate into a costly legal/ industrial dispute.

Introduction
• Leadership at the workplace.
• Role of managers as leaders in managing discipline, attending to employee grievances, reducing employee conflicts and creating industrial harmony in the workplace.

Managing misconducts
• Managing common misconducts in accordance with the Malaysian Employment Act 1955 for a healthier work environment. Discussion on:-
- Tardiness (Lateness & Habitual lateness);
- Absenteeism (during work hours, during holiday season, before/after weekend);
- Malingering (Abusing medical leave & fake medical certificates);
- Sexual harassment;
- Poor work performance/low productivity;
- Conflict of interest;
- Insubordination, etc.
• Case Study & Discussion : Selected Industrial Court cases and questions by participants.

Managing poor performance – Performance Improvement Plan (PIP)
• Managing poor performance and implementing a performance improvement plan (PIP) for a win-win work
environment.
• Discussion on company’s PIP procedure or designing a PIP procedure.
• Role Play.

Conflict Resolution, Counselling, Mentoring & Coaching
• Understand the difference between counselling, mentoring, coaching and its application in the workplace.
• Discussion on company’s counselling, mentoring or coaching procedure.
• Applying the appropriate conflict resolution intervention for a positive work environment.
• Role play.

Managing employee grievances
• Managing employee grievances based on company’s existing grievance procedure or designing a grievance procedure.
• Role play.

How to conduct a Domestic Inquiry
• Pre-DI procedures.
• Stages of DI procedure.
• Legal and procedural requirements to be complied with.
• Role of panel members, prosecutor, secretary in a DI.
• Punishment options.
- Employees under Employment Act 1955.
- Employees not under Employment Act 1955.
• Appeal procedure.
• Case Study : Selected Industrial Court cases.

Mock DI
• Mock domestic inquiry to enable participants to have a practical experience in conducting domestic inquiry with commentaries from the facilitator.

[04] SPEAKER PROFILE

TOH SIEW PAT

Toh started his career in 1977 as a police inspector with the Royal Malaysian Police.

He subsequently joined the private sector in 1991 as a security manager before taking up the role as a human resources manager in 1995. Since then, he has headed the human resource and administration department of various public listed companies.

Toh developed his passion for public speaking and training when he was invited to speak in a conference in 2004. Since then, he has conducted numerous in-house training programs, public training programs and has chaired/spoken at various public conferences & seminars. He also speaks in various seminars organized by various State Industrial Relations Departments and State Labour Departments.

Toh was the facilitator for the Malaysian Institute of Human Resource Management’s (MIHRM) Certificate in Human Resource Management (CHRM) and Diploma in Human Resource Management (DHRM) programs (Employment Act module, Industrial Relations Act module and Trade Unions Act module) from 2007 to 2011.
