(A) INTRODUCTION

Budget 2020 in an important budget that is expected to introduce new measures and incentives to boost the economy. As such, it is important for tax payers to be aware of the changes in tax regimes, which will bring about immediate impacts at both corporate and individual levels in the following year and those ahead.

Under present economic condition, or perhaps as part of a business strategy, a person may hold shares in more than one company. However, the directors have not have been well advised on the current tax updates. They may not be aware of possible corporate restructuring & group relief mechanisms which can reap tax benefits. The same is applied to those who have incorporated limited liability company to hold properties for any purpose they intended.

In this regard, the effect on holding share in more than one company, and/ or transfer of shares in the company that hold properties, could be profound. Understanding the implication of Real Property Gains Tax (RPGT) is important as it will affect the taxpayers in their businesses and cash flows.

With proper planning, the tax payers would be able to avoid undesirable tax implications and gain peace of mind in the business operation, knowing full well they are able to minimize tax risks and exposure.

Gan is the Partner of an established firm, who is a MIA member with ACCA qualification, has over 10 years of experience in the field of Taxation and Audit. He started work in a medium size audit firm and moved to a Big ten audit firm and subsequently started up with his own firm. He has vast experience in preparing and reviewing of auditing and taxation. Recently Mr. Gan intensively involves and represents clients in Tribunal and Special Commissioners of Income Tax for appeal in any taxation cases.
